Haiti's .ht relies on WIPO

Postby Research » Thu 13. Mar 2025, 11:39

The Geneva-based World Intellectual Property Organization (WIPO) is expanding its range of out-of-court domain name dispute resolution procedures. Since February 2025, legal disputes over domain names with the country extension .ht (Haiti) can also be brought before WIPO. The “Règlement sur la Procédure Alternative de Résolution de Litiges du domaine .HT” applies. It is only available in French and is based on the UDRP, but has some differences. For example, the complainant can invoke not only a trademark infringement, but also an infringement of personal rights. Furthermore, it is sufficient if either the registration or the use of the disputed domain is made “in bad faith”; the UDRP requires both cumulatively. WIPO is currently the only arbitration court that offers out-of-court dispute proceedings for .ht domains.
