The University of Latvia, administrator of the Latvian country code extension .lv, has announced that disputes over .lv domains can now be settled before the arbitration tribunal of the World Intellectual Property Organisation (WIPO). The procedure itself is closely modelled on the Uniform Domain-Name Dispute Resolution Policy (UDRP), but has several important differences that are specifically tailored to .lv. In addition to registered trademarks, the .LV Dispute Resolution Policy (lvDRP) also protects geographical indications protected in Latvia or under EU law as well as trade names registered in the Latvian commercial register. In addition, under the lvDRP it is sufficient to prove that either the registration or the use of the disputed domain is in bad faith, whereas the UDRP requires both cumulatively. Furthermore, the language of the dispute resolution procedure is Latvian, unless the parties agree on English. If both parties are located outside Latvia, the complaint can already be filed in English.
