Although the application window for new generic top-level domains is not expected to open until Q2 2026, the tug-of-war over individual endings has long since begun. Scott Florcsk, owner of Wallet Inc. and the Web3 domain provider Unstoppable Domains Inc. are in a dispute over .wallet before the US District Court for the District of Delaware. Florcsk, who markets .wallet domains himself, is being financially supported by Namecheap. After a series of legal disputes, only one claim remained: Florcsk demanded a declaration that it would not infringe any trademark rights of Unstoppable Domains by selling .wallet domains. However, Unstoppable Domains had already committed not to sue Florcsk for infringement of intellectual property rights in .wallet and agreed to extend this commitment to registries and registrars. From Unstoppable Domains' point of view, the action for a declaratory judgment was therefore invalid. Florcsk, on the other hand, wanted to ensure that Unstoppable Domains did not sue for other domain extensions. In a decision dated January 6, 2025, the court followed Unstoppable Domains' view and found that the declaratory judgment sought by Florcsk only applied to .wallet. It is therefore safe to assume that there will be several applications for .wallet at ICANN next year.
